TERMS AND CONDITIONS

THIS IS YOUR AGREEMENT WITH LOVESICK WEDDINGS (LOVESICK).

WHEN PLACING AN ORDER WITH LOVESICK, YOU ACCEPT THIS AGREEMENT IS BINDING AND YOU AGREE TO ALL TERMS CONTAINED WITHIN.

PLACING AN ORDER

  • When a Client places an order with LOVESICK, they will receive confirmation that the items as ordered are available for the specified date and period of time. The Client agrees to pay a non-refundable deposit of up to 50% of the total order amount within 7 days of the order being placed (“The Deposit”). If payment of the Deposit is not made within this timeframe, the order will not be confirmed and the items may be allocated to another client.

  • If for any reason items within the order become unavailable following an order being placed, and after The Deposit has been paid, LOVESICK will notify the Client as soon as possible to offer replacement items or to confirm a reduction in the final balance invoiced to the Client.

  • The Client is able to make any changes to the order prior to The Deposit being paid, subject to availability. Once The Deposit has been paid the Client will be able to make changes to, or cancel the order in accordance with the Cancellation Policy found below.

  • LOVESICK has a minimum hire order of $200. This price is exclusive of an additional Delivery and Set Up fee unique to each order and its requirements.

  • It is your responsibility to ensure that all details of your booking are and remain correct. Please advise any errors or changes to your booking in writing as soon as possible.

    ALL DEPOSITS ARE FINAL AND NON-REFUNDABLE

HIRE DURATION

  • Hire duration of items from LOVESICK begins from the stated ceremony commencement time and concludes upon the completion of the prior agreed length of hire duration. During this time, the Client is responsible for all hired items and accepts liability for any theft or damage that may occur, including as a result of unreasonable use, transportation, weather conditions, wilful damage, negligence, or any unforeseen circumstances.

  • Standard hire duration is 1 hour and 30 minutes after the stated ceremony commencement time. LOVESICK reserves the right to pack up decorations before this if the guests have left the immediate area.

    AS THE CLIENT YOU AGREE TO:

  • Not alter or make any additions to the items including but without limitation altering, making any additions to, defacing or erasing any identifying mark, plate or number on or in the items or in any other manner interfere with the items.

  • Indemnify LOVESICK of any disturbances to your setup as a result of inferences by members of the public between the time of setup and event commencement.

  • Identify and hold harmless LOVESICK in respect of all claims arising out of the Client’s use of the items.

  • Indemnify LOVESICK of any responsibility or liability for any accident, incident or damage of persons or

    property while items are in use by the Client.

    CANCELLATION POLICY

  • The Client may cancel their order at any time but the Deposit is non-refundable.

  • The total balance is required to be settled 60 Days from the hire date.

  • If the entire order is cancelled less than 60 days before the event for any reason, 100% of the total quoted amount will be FORFEITED.

  • Orders (including inventory numbers) may be changed up until 60 days before the commencement of the hire period. However, the client may only LOWER the order inventory numbers of items by 25% of the total amount.

  • The Client may add items to their order at any point before the hire date, however if inventory numbers are reduced within 60 days of the hire date, there will be no reduction in the final balance payable.

  • If the hire order is postponed for an alternate date within 60 days of the initial hire date, there will be a $550 ‘Change of Date Fee’ applied.*

    *This Fee will be waived in the event of a COVID-19 government restriction.

WEATHER

  • The Client accepts the responsibility to make suitable arrangements in the event of inclement and adverse weather conditions.

  • There will be no refund for any hire cancellations due to inclement weather.

  • In the event of inclement weather conditions, The Client is responsible for making a decision regarding wet weather plans and notifying LOVESICK of these within 5 hours before the stated commencement time of the hire duration.

  • Specified times of the hire duration cannot be altered or postponed as a result of adverse weather conditions. Where possible, and subject to availability, LOVESICK may be able to provide the same items at an alternate time for an additional fee.

  • If The Client changes their hire location to a wet weather alternative, additional fees for difficult access may be charged at LOVESICK’s discretion.

  • To ensure the health & safety of our clients and their guests the use of certain hire items may be restricted in the event of inclement weather conditions.

  • In the event that weather conditions make it unsafe to use certain hire items or there is a likelihood of damage to the items, LOVESICK reserves the right to refuse the use of these items without notification and without refund.

  • LOVESICK reserves the right to refuse setup of certain hire items which are deemed unsuitable for, or do not fit within the physical confines of wet weather location alternatives. No refund will be payable for their absence.

  • SITE ACCESS AND APPROVAL

  • A ‘Difficult Access Fee’ will be assigned by LOVESICK if the site chosen by The Client is determined to be difficult to access. Eg. Stairs, hills, or long conveyance without direct Vehicle access.

  • A determination of Difficult Access may be omitted from the initial quote if LOVESICK are unaware of any difficult access. This fee may be added by LOVESICK at any stage up to the date of hire, if a site visit determines it to be difficult to access.

  • If there is a gate/vehicle access to the site, it is the customers responsibility to organise/gain keys to allow access for LOVESICK vehicles. The Client shall be solely responsible for any gate access keys borrowed or hired.

  • It is The Clients responsibility to provide any relevant authorities the necessary notice of their intention to erect the equipment or to have the equipment erected, and shall pay all fees in connection therewith.

  • It is The Clients responsibility to ensure that the site is cleared and ready for the erection/ set up of the hired items.

  • It is The Clients responsibility to ensure all outdoor set ups comply with council rules and regulations.

  • In the event that LOVESICK incurs or suffers any loss, cost, fines or damages as a consequence of the Customer’s failure to carry out its obligations under these terms the customer shall be solely responsible and shall indemnify LOVESICK for any such loss, costs or damages.

    PHOTOGRAPHY AND VIDEOGRAPHY

  • LOVESICK may take photos of your event or contact the event Photographer/Videographer to use images on our website or in advertising material. Please notify us in writing prior to the hire date if you prefer that we do not take or use any photos of your event.

  • Photos of our equipment must not be used for commercial purposes without written permission.

PUBLIC HOLIDAYS

  • A surcharge of $150.00 will apply to all services booked and carried out on Public Holidays.

COVID-19 POLICY

  • All clients have the opportunity to rebook their wedding or event with LOVESICK at no extra cost or fee within 18 months of the original event date.

  • The rebooking date must be agreed to by LOVESICK based on existing availability.

  • Non transferrable costs for items already purchased including flower petals, grazing food and date specific vinyl signage will have to be covered.

SEVERANCE

• Should any of these terms or any part of them be held to be invalid or otherwise unenforceable, such term or part of it may at LOVESICK’s sole discretion be severed without affecting the validity or enforceability of the remaining terms.

WAIVER

• Any delay or failure by LOVESICK to enforce its rights at any time or for any period in relation to any one or more of these terms shall not be a waiver of them or of the right at any time subsequently to enforce them.

BY HIRING WITH LOVESICK WEDDINGS YOU AGREE TO ALL TERMS AND CONDITIONS IN THIS DOCUMENT AND THESE TERMS AND CONDITIONS ARE BINDING.
